TERMS AND CONDITIONS OF THE GROUND AND MULTI-LEVEL PARKING

AT STRZEGOMSKA 42 A, B, C, AA, AB, AC

 

§ 1 GENERAL PROVISIONS

 

1.    The parking area is an integral part of the property at ul. Strzegomska 42 in Wrocław, and is part of the Millennium Towers office complex.

2.    The area of ​​the Car Parking includes ground part (hereinafter: Ground Car Park) and the multi-storey part (hereinafter: Multi-storey Car Park). The term Car Parking in these Regulations includes both ground and multi-storey Parking.

3.    The Car Parking is managed by Descont sp. z o.o. Sp. komandytowa, with its registered office in  Wrocław at ul. Strzegomska 42, hereinafter referred to as the Administrator.

4.   The entity authorized to exercise control is the Security of the Facility.

5.   Each vehicle user (hereinafter: the User) by entering the area of ​​the Car Parking accepts the provisions of these regulations (hereinafter: the Regulations) and undertakes to strictly comply with them.

6.   Upon entering the Car Parking, a parking space lease agreement is concluded between the vehicle driver and the Administrator. If the driver of the vehicle is bound with the Administrator by a separate rental agreement, the provisions of the Regulations will only supplement its content.

 

§ 2 TERMS OF USE OF THE CAR PARKING
 
1.    The Car Parking is paid, supervised, unguarded. Leaving the vehicle in the Car Parking does not have the sign of concluding a storage agreement, within the meaning given to it by art. 835 ff. of the Civil Code. The user of the vehicle, leaving it in the Car Parking, rents a parking space only for a certain period of time. The elements of the Car Parking fencing, in particular the gates and barriers, are only intended to prevent the use of the Car Parking without paying the appropriate fee or using a subscription card.
2.    The Car Parking is continuously monitored solely for the purpose of controlling the provisions of the Regulations by the Car Parking Users, in particular for the purpose of verifying the use of the Car Parking and paying the parking space charges.
3.    Entering the area of ​​the Car Parking is tantamount to consent to the possible processing of personal data of its Users. The administrator of personal data is the Administrator, i.e. Descont sp. z o.o. sp. k with its registered office in Wrocław, ul. Strzegomska 42, 53-611 Wrocław, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for Wrocław - Fabryczna, 6th Commercial Division of the National Court Register under KRS number: 0000490693. Information on the processing of personal data is included in the Principles of Personal Data Protection in the company Descont Sp. z o. o. Sp. k. and the Information of Security Policy of Descont Sp. z o. o. Sp. k. based in Wrocław.
4.    The Car Parking is open all days of the week, 24 hours a day.
5.    Users of the Car Parking, bound by lease agreements with the Administrator, are obliged to park only in rented places and are obliged to clearly mark, strictly in accordance with the Administrator's guidelines, indicated and handed over to them for the exclusive use of parking places.
6.    The Users are responsible for administering the provided parking spaces, deciding to whom and for how long a given parking place will be allocated. The Administrator is not entitled to decide how the User administers the parking space provided for use, unless it is inconsistent with the provisions of the Regulations or violates the interests of other Users.
7.    Parking and stopping of vehicles is possible only at the parking space, understood as an area in the Car Parking, designated for parking vehicles, separated by lines.
8.    Persistent or gross violations of these Regulations may result in a temporary or total ban on              
     entering the Car Parking area.
§ 3 MULTI-LEVEL PARKING
1.   The Administrator provides the Parking Users with parking services consisting in renting for a fee for a specified period (calculated in hours, days or months) of parking spaces intended only for parking passenger cars.
2.   The first 10 minutes of parking is free. During this time, you must leave the Car Parking, if there are no free parking spaces.
3.   By entering the parking area, a parking space rental agreement is concluded under the conditions set out in these Regulations and in accordance with the price list. The contract ends when you leave the Car Parking after paying the amount due for the parking time at the automatic cash register or when the subscription card expires. The proof of conclusion of the contract is a subscription card or a parking ticket.
4.   When entering the Car Parking, you should:
a.    stop in front of the barrier, point the subscription card into the field of view of the antenna and, in the case of using the hourly system, take a parking ticket from the terminal enabling entry to the Car Parking and being the basis for calculating the due parking fee (the ticket should be kept until leaving the Car Parking)
b.    start entering after the barrier is fully opened. It is forbidden for two cars to pass when the barrier is raised once - it may damage the vehicle or the barrier. The barrier closes automatically after each pass.
5.    In the event of loss of the subscription card, one should use a one-time parking ticket and pay for it according to the price list, then notify the Administrator in order to block the card and pay for a new card according to the price list at the Administrator's office after prior telephone contact. There are no refunds or deductions from monthly fees in such cases.
6.    In the event of a temporary lack of a subscription card, a one-time parking ticket should be used and paid according to the price list. There are no refunds or deductions from monthly fees in such cases.
7.     When leaving the Car Parking, you should:
a.    in the case of using the hourly parking ticket system, pay the parking fee at the automatic self-service cash register located on the "0A" level, next to staircase A. The parking fee must be paid before starting the vehicle and leaving the parking lot, by scanning the parking ticket and making the payment. Confirmation of payment is issued by the cash register on request, after pressing the appropriate button. The ticket must be kept until departure, where it must be scanned at the terminal, which will raise the exit barrier. After making the payment, the User has 15 minutes to leave the Car Parking. If the User exceeds the time limit for leaving the Car Parking, the message "ticket unpaid" will appear on the exit terminal. Departure will be possible after paying the fee for the additional parking time, which should be paid at the automatic ticket office.
b.     In the event of losing a parking ticket, before leaving the Car Parking, press the "Lost ticket" button at the ticket office and pay the fee for the lost parking ticket.
c.     When using subscription cards, bring the subscription card close to the reader, wait for the barrier to rise and leave the parking area.
8.    In case of problems with entry/exit, please contact security via the intercom located in the terminal at the barriers.
9.    The Car Parking access card is equipped with the antipass back system, which blocks the possibility of using the same card again in the entry terminal, if the vehicle registered in the system with this card has not left the Car Parking; similarly, it blocks the possibility of using the same card again in the exit terminal, if the vehicle registered in the system with this card has not entered the Car Parking.
10.  The access card is dedicated to one specific vehicle.
11.   It is forbidden to enter the Car Parking by collecting a ticket from the terminal, and leaving using a subscription card, downloading the ticket obliges the User to pay it at the cash register.
12.  Do not enter the Car Parking if the barrier is raised, without collecting a ticket or without reading the subscription card by the system. You should wait for the barrier to drop or contact Security. If you do not comply with the above, you must pay a "Lost ticket" fee at the cash register to leave the Car Parking.
13.  The fee for parking in the hourly system is calculated for each started hour/day on the basis of the ticket collected at the entrance, and is paid at the automatic cash register located on the "0A" level at the staircase A, in accordance with the price list.
14.  The dimension of parking space is 2.5 m x 5 m.
15.  Guests, i.e. users of the parking lot, who do not have spaces rented/assigned under the Rental Agreement, are obliged to park vehicles at the "0A" and "0B" level of the Car Parking.
16.  On levels "0" and "-1" are located bicycle boxes intended exclusively for employees of companies that have rented bicycle boxes. Access to the bicycle boxes is provided only through side entrances from the ground level with the use of combination locks or access control.
17.   In the entire Car Parking, it is strictly forbidden to use vehicles other than a passenger car, in particular bicycles, motorcycles, segways, scooters, skateboards, rollerblades or roller skates.
 
§ 4 GROUND PARKING
1.    The Car Parking may only be used by persons authorized by the Administrator, i.e.:
a.    tenants of office space in the Millenium Towers complex (based on the main lease agreement), their employees and persons cooperating with them;
b.    natural or legal persons renting parking spaces;
2.    Entry to the Car Parking is possible only in 2 cases:
a.    using a subscription card. If the driver of the vehicle does not have a subscription card, fails to show it or it has expired, he is not authorized to use the Car Parking.
b.    with the consent of the Parking Security. In the absence of such consent, the vehicle driver is obliged to immediately leave the Car Parking, under the threat of imposing a regulatory fee, or to go to the Multi-storey Car Parking, the functioning of which is regulated in §3 of the Regulations.
3.    Free of charge, only in marked places, for a period not longer than 10 minutes, the Car Parking may be used by:
a.    suppliers - only in Unloading Zones
b.    couriers,
c.     taxi drivers,
d.    other persons authorized by the Administrator or a person authorized by him to enter the Car Parking.
4.    The persons referred to in par. 3, at the moment of entering the parking area, they conclude a free-of-charge lease agreement with the Administrator for a marked parking space for 10 minutes, or for another period agreed with the Administrator.
5.    If the driver of the vehicle exceeds the time referred to in sec. 3 above, will be treated as a person using a marked parking space without a contract. For the non-contractual use of the parking space, the driver of the vehicle will be obliged to pay a fee in accordance with the provisions of the Regulations.
6.     If it is not possible to park in the marked places referred to in sec. 3, the driver of the vehicle is obliged to immediately leave the Car Parking, under the threat of imposing a fee provided for in these Regulations.
7.    Parking of bicycles and scooters by employees of the Millennium Towers business complex is allowed only in bicycle boxes dedicated to them. Public bicycle racks are for guests only.
8.     It is forbidden to park bicycles, scooters near barriers, lanterns, benches, litter bins, trees and others.
9.    Motorcycles and scooters may be parked only in dedicated places, with the consent of the Administrator.
10.  Large deliveries in the Car Parking area may only be made at the rear entrances to the office buildings that are part of Millenium Towers, after obtaining the consent of the Administrator, at least 1 day before the planned delivery.

 

§ 5 OBLIGATIONS OF THE PARKING USER / SAFETY REGULATIONS
1.    The Car Parking User is obliged to comply with horizontal and vertical road signs, as well as indications and instructions of the Car Parking staff.
2.    A vehicle left in the Car Parking should be locked and its contents secured.
3.    There is a speed limit of 10 km/h in the Car Parking.
4.    In the Car Parking area it is forbidden to:
1)   park vehicles outside the places designated for this purpose, in places marked as "Reserved", "Subscriptions" or marked with the name of the company (in the absence of appropriate authorizations), park in places other than those that have been designated to the User in the rental agreement, or in a way that makes it difficult for other Car Parking Users to enter or exit
2)   smoke and use open fire, consuming alcohol and taking drugs
3) wash and clean motor vehicles and making vehicle repairs
4) storag of fuels, flammable substances and empty fuel containers
5) refill fuel tanks from canisters
6) unjustified leaving the vehicle with the engine running
7) towing
8) entry and parking of vehicles:
·         transporting flammable, corrosive, explosive materials and other similar materials and  substances that may pose a threat to people and property
·         with a leaking fuel/braking system, etc., causing permanent soiling of the floor
·          with semi-trailers and trailers
·         damaged, broken
·         without current technical tests
·         without paid compulsory third party liability insurance (OC)
·         with regard to which there is a suspicion that they may pose a threat to the Car Parking Users or to the Car Parking itself
9) conduct any promotional campaigns, including photo sessions for private or commercial use, commercial or advertising activities, without the prior consent of the Administrator
10) store flammable, corrosive, smelly substances or other materials that may pose a threat to health or life
11) occupate, block with any object the corridors and communication routes and arrange in the communication routes the waiting room or storage places
12) leaving vehicles in the carsharing system, cars for minutes
13) leaving a city-type vehicle, scooter or electric scooter in any place
14) entry and/or exit of more than one vehicle using one subscription card.

5.    The User is obliged to immediately make the parking space available to the Administrator in the event of a need to remove a failure, inspect or repair the parking area, rescue operation, or other situations in which making the space available will be necessary. If contacting with the User is difficult or the User refuses to provide a parking space in an emergency, the Administrator will be authorized to independently remove the vehicle from the occupied parking space and place it in another parking space or in another place intended for parking vehicles. In the event of refusal to provide a place, the removal of the vehicle from the parking space and its placement in another place will be at the expense of the User.

6.    The User is obliged to maintain the rented places in a condition not worse than normal wear and tear throughout the period of use.

7.    In the Multi-storey Car Park it is forbidden to:

1)    entry of vehicles higher than 1.90 m (including antennas, roof racks, etc.) or with a total weight exceeding 3.5 t

2)    walking on the ramps between the Car Parking levels. Should be used for this lifts, staircases or steps located at one of the ramps.

 

§ 6 RESPONSIBILITY OF THE MANAGER AND USERS OF THE CAR PARKING
 
1.    Subject to the provisions of this paragraph, the liability of the parties is determined by the relevant provisions of the Civil Code, in particular regarding the lease agreement.
2.    The Administrator shall not be liable for any damage resulting from: force majeure, natural elements, theft (burglary, robbery, etc.), pillage, destruction or damage to vehicles located in the Car Parking, as well as theft or damage to items left in them or constituting their equipment.
3.    The Administrator's liability for traffic and parking damage to vehicles and persons using the Car Parking is excluded.
4.    The User and the persons accompanying him are liable for any damage caused to the Administrator, as well as to third parties, by the vehicle or arising in connection with the use of the parking space, in particular due to contamination of the Parking lot surface as a result of leakage of liquids from the vehicle (oil leakage brake fluid, coolant, etc.). In the event of damage, the User is obliged, before leaving the Car Parking, to immediately inform Security about this fact in order to draw up an appropriate protocol.
5.    The Administrator is entitled to decide whether the damage caused by the User can be repaired by the User himself. If the damage can be repaired by the User himself, the User, after receiving such information from the Administrator, is obliged to repair the damage within 3 days, or to order this to Administrator at his own expense. If the repair of the damage is not possible by the User, the Administrator has the right to make the repair at the User's cost and risk within the time limit set by him.
6.    If the User violates the provisions of these Regulations, the Administrator may terminate the parking space rental agreement with immediate effect, and apply the measures necessary to restore the condition consistent with the Regulations, including removal of the vehicle at the User's cost and risk, to which the User agrees . The user bears the costs of storing the vehicle until its picked up.
7.    If the vehicle is left in the Car Parking by a person who does not have a valid subscription card for a period longer than 7 days, the Administrator is entitled to remove the vehicle and change its parking place at the User's cost and risk, to which the User agrees. The user bears the costs of parking the vehicle in a new place until its picked up. Until the vehicle is removed, the Administrator is entitled to appropriate remuneration according to the price list.
8.    The administrator is entitled to remove the vehicle at the expense and risk of the Car Parking User in the event of a sudden and/or justified threat caused by the vehicle.
9.    The Administrator and entities authorized by him may prevent a User who violates the provisions of the Regulations from leaving the Car Parking until the User pays all due fees.
10.           The administrator, due to settlements with the User, has the right to pledge on the User's vehicle.
11.           The provisions of this paragraph shall also apply accordingly to persons referred to in § 4 sec. 3 of the Regulations.

 

§ 7 FEES FOR VIOLATION OF THE REGULATIONS
 
1.    In the event of a violation of the provisions of the Regulations, the Administrator is entitled to charge the User with a regulation fee.
2.    Regulation fee for:
a.    exceeding the time of free use of the marked parking space referred to in § 4 sec. 3 of 
the Regulations is PLN 200
b.   parking in non-designated places, blocking traffic in the Car Parking, parking in a way that makes it difficult for other Car Parking Users to enter or exit is PLN 200
c.    parking in unauthorized places, in a parking place marked as "Reserved", "Subscriptions" without the appropriate authorization is PLN 600
d.   parking in a different place than the one designated in the rental agreement concluded with the User, but located on the same level of the Parking lot is PLN 600
e.    parking in a different place than the one designated in the rental agreement concluded with the User, and additionally, is located on a different level of the Parking lot is PLN 1,000
f.     parking bicycles, motorcycles, scooters in non-designated places is PLN 200
g.   blocking the fire road is PLN 200
h.   violation of the provisions of these Regulations amounts to PLN 1,000
i.     performing photo sessions for private use without the Administrator's written consent is PLN 2,000
j.     performing photo sessions for commercial use without the Administrator's written consent is PLN 10,000
3.    Regulation fees may be imposed by the Administrator or a person appointed by him.
4.    The regulation fees may be added together. The driver of the vehicle is obliged to immediately pay the regulation fee at the cash register located in the Multi-storey Car Parking, by pressing the "Regulation fee" button the appropriate number of times and paying the indicated fee.
5.    The Car Parking Administrator has a statutory lien on the parked vehicle of the User and the person referred to in § 4 sec. 3 of the Regulations.
 
§ 8 FINAL PROVISIONS
 
1.    Any comments and reservations regarding the functioning of the Car Parking should be reported to the Administrator by phone at 71 355 07 53 (Mon-Thursday 8.00-16.30, Friday 8.00-14.00) or to the e-mail address: parking@descont.pl
2.    These Regulations are valid from 01/05/2022 and replace all previous regulations.
